KEWAJIBAN NAFKAH SUAMI TERHADAP ISTRI DALAM PERSPEKTIF HUKUM ISLAM: ANALISIS LITERATUR NORMATIF TERHADAP PRINSIP KEADILAN KELUARGA

Abstract

Maintenance (nafkah) is one of the fundamental obligations in the relationship between husband and wife and holds an important position in Islamic law. This study aims to analyze the concept of nafkah through a normative literature approach by examining Islamic legal sources such as the Qur’an, Hadith, classical fiqh books, as well as positive legal regulations in Indonesia. This research employs a library research method with a normative juridical approach. The results of the study indicate that the obligation of nafkah is the husband’s responsibility as a consequence of a valid marriage contract. Nafkah includes not only material needs such as food, clothing, and shelter, but also non-material needs in the form of affection, protection, and the fulfillment of the wife’s biological rights. From the perspective of Islamic law, the amount of nafkah is adjusted to the husband’s financial capability and the standards of propriety prevailing in society. Furthermore, Indonesian positive law through the Compilation of Islamic Law also reinforces the husband’s obligation to provide family maintenance. This study emphasizes that the fulfillment of nafkah is an important instrument in maintaining household harmony and realizing the objectives of marriage characterized by sakinah, mawaddah, and rahmah.
